Does AI art deserve (copy)rights? 🖼

Above is an award-winning AI art piece from the 2022 Colarado State Fair, ‘Théâtre D’opéra Spatial’ created by Matthew Allen. But since then, it has been ruled ineligible for copyright protection by the US Copyright Office.

Why, you ask? 🐤

The issue at hand is that Allen used the generative AI program Midjourney to create the artwork. However, copyright protections do not apply to AI creations, extending even to those that highly impress art connoisseurs. 🎨

Allen argues that he made significant efforts to register his AI-generated artwork by:

• Editing the output of the AI program Midjourney

• Adjusting elements in Adobe Photoshop

• Further enhancing the art using Gigapixel AI.

In July, Allen appealed the decision once again, arguing that the Copyright Office had overlooked the "essential element of human creativity" required in using Midjourney. He also attempted to justify his case under the fair use doctrine, claiming that his work constituted a ‘‘transformative use of copyrighted material and should therefore be eligible for registration.’’

However the court’s final ruling on the 5th of September deemed that the work “cannot be registered.”
